At Socialmediatoupr LLC we treat the personal information of the families who trust us with the same care we apply to a Hacienda or FEMA case file: discreet, rigorous and traceable. This policy explains what data we collect, why we need it and what your rights are.
1. Who we are
Socialmediatoupr LLC, with offices at 254 San Francisco Street, Suite 3-B, Old San Juan, PR 00901, operates the socialmediatoupr.com website. We comply with Puerto Rico's Act 75, Act 247-2018 on breach notification, the federal Gramm-Leach-Bliley Act, and, where applicable, the General Data Protection Regulation (GDPR) for visitors from the European Union.
2. Data we collect
We only collect the data you provide voluntarily through our contact form (name, email and message), as well as basic technical data generated by your browser (truncated IP address, device type, language) when you consent to analytical cookies.
3. What we use your data for
We use your information to (i) respond to your consultation request, (ii) prepare the preliminary benefits analysis, (iii) comply with P.R. tax record-keeping obligations, and (iv) measure site performance. We never sell your personal information to third parties.
4. Legal basis for processing
We process your information based on (a) your express consent when submitting the form, (b) pre-contractual measures requested by you, (c) compliance with Puerto Rican and federal legal obligations, and (d) our legitimate interest in keeping the site secure.
5. How long we keep your data
Requests that do not turn into engagements are deleted after 18 months. Active case files are kept for 7 tax years, as required by local rules, and then securely destroyed.
6. Who we share your data with
We only share data with (i) the relevant government agencies when you have authorised us to file a case on your behalf, and (ii) audited technology providers based in the United States (encrypted storage, transactional messaging). All sign confidentiality agreements aligned with HIPAA and GLBA.
7. Your rights
You may request access to, rectification, objection or erasure of your data at any time by writing to privacy@socialmediatoupr.com. We will reply within a maximum of 30 calendar days.
8. International transfers
Your data is stored in data centres located in the continental United States and Puerto Rico. If you visit from the European Union, transfers are governed by the European Commission's Standard Contractual Clauses (2021 version).
9. Information security
We apply TLS 1.3 encryption for all communications, mandatory two-factor authentication for internal access, encrypted backups and yearly independent audits performed in 2025 and planned again for 2026.
10. Changes to this policy
We may update this policy to reflect legal or service changes. The current version is always published on this page, with the last updated date clearly displayed.
